3. Informal dispute resolution (please try first)
Before initiating any formal legal action, we ask that you email legal@hardiktrehan.com with:
- A description of the dispute.
- The specific outcome you are seeking.
- Any relevant order numbers, screenshots, or correspondence.
- The best way to reach you for a 30-day informal-resolution window.
We will respond within 10 business days and work with you in good faith to resolve the matter. The 30-day window pauses any deadlines for further action; if we cannot reach resolution, you retain all rights you would otherwise have.
4. Governing law & venue
The Terms of Service are governed by the laws of the State of Washington, U.S.A., without regard to its conflict-of-laws principles. The parties agree that any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in King County, Washington, and consent to personal jurisdiction there.
We do not require pre-dispute mandatory arbitration; you keep your right to a jury trial in the courts identified above.
5. Consumer-protection venues that apply regardless
Nothing in section 4 or in our Terms of Service deprives you of consumer-protection rights you have under your home jurisdiction. Specifically:
- U.S. consumers may file in small-claims court in their home district for claims within the small-claims threshold, and may file complaints with the Federal Trade Commission at reportfraud.ftc.gov or their state attorney general.
- EU consumers may use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr, or contact a national consumer protection center.
- UK consumers may use Citizens Advice or the Competition and Markets Authority and retain rights under the Consumer Rights Act 2015.
- California consumers may file privacy complaints with the California Privacy Protection Agency (CPPA).
- Any consumer may file payment-related disputes with their card-issuing bank; please contact us first so we can usually resolve the issue without a chargeback.
6. Data-subject access requests
To exercise any data-subject right under the GDPR, UK GDPR, CCPA / CPRA, or any other applicable privacy law, email legal@hardiktrehan.com with:
- The right you are exercising (access, deletion, correction, portability, restriction, objection, opt-out).
- The jurisdiction whose law you are relying on (if you know).
- Verification that you are who you say you are — sending from the email on the account is usually enough; we may ask follow-up questions for sensitive requests.
- For agent requests, written authorization signed by the data subject.
Standard response time is 30 days for GDPR/UK GDPR, with a possible 60-day extension for complex requests; 45 days for CCPA/CPRA, extendable to 90 with notice. There is no fee unless the request is manifestly unfounded, excessive, or repetitive.
See the Data Processing Addendum for the full list of rights by jurisdiction.
7. How to file a formal complaint
For formal complaints not resolved through the informal channel:
- Email legal@hardiktrehan.com with subject line beginning “FORMAL COMPLAINT:”.
- Include all relevant facts, dates, evidence, and the relief you seek.
- We acknowledge within 5 business days.
- We respond substantively within 30 days unless the complexity requires longer (we will tell you).
- If unresolved, you may proceed under section 4 or section 5 as applicable.
8. Service of legal process
Legal process (subpoenas, court orders, civil investigative demands) should be directed to legal@hardiktrehan.com. We will accept properly-served process by email where the applicable rules permit, and otherwise will provide a postal address on request. We comply with all valid legal process and will, where lawful, notify affected users.
9. International contact points
We are a small operator and do not currently maintain a GDPR Article 27 representative in the EU or a UK Article 27 representative. EU/UK residents may contact us directly at legal@hardiktrehan.com and we will respond. If you believe a Representative is required for your specific use case, please let us know.
