Terms of Service

Welcome to hardiktrehan.com (the “Site”), including HT Hub (games and AI tools sub-site), AI Battle Arena, the 17 AI tools (astrology suite, Prompt Lab, Code Duel, Roast Battle, Model Showdown, and others), public user profiles, leaderboards, paid subscription plans, credit packs, blog, music, stories, and any related services. The Site is operated by Nyza Creations LLC, a Washington State limited liability company (“we”, “us”, “our”).

By accessing or using the Site you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Site. These Terms are part of our broader Legal Center and incorporate by reference the Privacy Policy, the Acceptable Use Policy, the Subscription & Refund Policy, the AI Disclaimer, the Cookie Policy, the DMCA Policy, and the Children & COPPA Policy.

1. Eligibility

You must be at least 13 years old to create an account, submit scores, or use any AI tool. You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to purchase a paid subscription or a credit pack. If you are under the age of majority, you may use free portions of the Site only with the consent of a parent or legal guardian. See our Children & COPPA Policy.

2. Your Account

You are responsible for safeguarding your sign-in credentials and for all activity under your account. Tell us immediately at support@hardiktrehan.com if you suspect unauthorized use. You agree to provide accurate information when registering and keep it accurate while your account is active. You may not impersonate others or use offensive display names.

3. Acceptable Use

The Site is subject to the Acceptable Use Policy (the “AUP”), which lists in detail what you may and may not do. At a minimum, you agree not to:

• Use the Site for unlawful, harassing, defamatory, or fraudulent purposes.
• Break security, scan for vulnerabilities, or interfere with the Site, Firebase backend, Stripe, OpenRouter, ElevenLabs, Perplexity, or other third-party services we use.
• Submit fake, automated, or manipulated scores to the leaderboard, or use bots / scripts to gain an advantage in any game.
• Use any AI tool to generate content that is illegal, sexually exploits minors, targets or harasses real individuals, or violates the policies of the underlying AI providers.
• Submit personal, sensitive, regulated, or confidential information (yours or anyone else’s) into AI inputs. Treat all AI inputs as public.
• Scrape, mass-download, or republish Site content without permission.
• Circumvent the credit ledger, free-tier rate limits, or any other paid-feature gating.
• Resell credits, share account credentials, or use a single account for multiple humans.

We may suspend or terminate access — and forfeit any unused credits if the violation is willful — for any user who violates these Terms or the AUP.

4. AI Tools — High-Importance Disclaimer

The AI Battle Arena, astrology suite, Prompt Lab, Code Duel, Roast Battle, Model Showdown, and every other AI-driven feature on the Site generate output using third-party AI models. We do not author, review, or endorse those outputs. AI-generated content may be inaccurate, fabricated (“hallucinated”), biased, offensive, or simply wrong.

Do not rely on AI output as professional, legal, medical, financial, psychological, or factual advice. The Site is provided for entertainment and educational purposes. Astrology readings are for fun and self-reflection, not predictions of fact. Code generated by Code Duel is a starting point, not production-ready code. Read the full AI Disclaimer — this is the highest-risk document on the Site and you accept it by using any AI tool.

5. Paid Plans, Credits & Billing

Every AI reading/tool is free up to a daily limit (1 run/day signed out, 5/day signed in). For more, we offer one paid subscription —Plus ($5/month) — and one-off credit packs at $1.99 / $7.99 / $24.99. Plus grants 500 credits/month (used only after your free daily runs) and unlocks voice narration in the Arena and custom tournament fighter picks. Saving and downloading your readings is free for everyone. The full breakdown is on thepricing page.

Subscriptions auto-renew monthly to the same payment method until you cancel. You can cancel at any time from your account settings; cancellation takes effect at the end of the current paid period. Unused monthly credits do not roll over after cancellation.

Credit packs are non-refundable once any credit from the pack has been used. Credits consumed by AI tool calls are a digital service that is delivered immediately and cannot be returned. Payment processing is handled by Stripe. Your card data never touches our servers. We receive only the metadata listed in section 1e of the Privacy Policy. By purchasing, you also agree to Stripe’s Services Agreement.

Prices are in U.S. dollars and exclusive of any applicable taxes. We may change pricing for future billing periods on at least 30 days’ notice to active subscribers.

6. Music, Photos, and Other Content

Original songs, recordings, photos, blog posts, code, designs, and other creative material on the Site are owned by Nyza Creations LLC, Hardik Trehan, and/or Nyza Studios and are protected by copyright and other laws. You may not reproduce, distribute, modify, or create derivative works without written permission, except where allowed by law (fair use, embedded social previews, etc.).

Any user content you submit (e.g. messages via the contact form, AI inputs, leaderboard display name, profile data) you grant us a non-exclusive, worldwide, royalty-free license to use solely for operating and improving the Site. AI-generated outputs you create while using the Site are licensed to you as far as we have the right to license them; the underlying AI providers may impose their own terms (typically allowing commercial use of outputs you generate).

7. Copyright & DMCA

We respect intellectual property rights and respond to notices of alleged infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. To submit a takedown notice, file a counter-notice, or contact our designated agent, see the DMCA Policy.

8. Third-Party Services

The Site uses Stripe (payments), Firebase / Google Cloud (authentication, Firestore, hosting), Google Sign-In, Google Analytics 4, OpenRouter (gateway to Google / OpenAI / Anthropic / Meta / Mistral / DeepSeek / xAI / Moonshot / Qwen models), ElevenLabs (TTS for paid users), and Perplexity (web research in Arena). Your use of those services is also governed by their respective terms. We are not responsible for third-party services or for AI providers’ outputs.

9. Privacy

Our handling of personal data is described in our Privacy Policy and Data Processing Addendum, both incorporated into these Terms by reference.

10. Disclaimers

The Site is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or absence of harmful components. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that AI outputs will be accurate, useful, or free of bias. Some jurisdictions do not allow exclusion of implied warranties — in those jurisdictions, exclusions apply to the maximum extent permitted by law.

11. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, profits, goodwill, revenue, or opportunity, arising out of or related to your use of the Site — including any AI-generated output, lost game scores, missed credit grants, service interruptions, or reliance on astrology / AI tool output for any real-world decision. Our total aggregate liability to you for any claim arising out of or relating to the Site is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD $50. Nothing in these Terms limits liability that cannot be limited under applicable law (e.g. gross negligence, willful misconduct, or consumer-protection statutes).

12. Indemnification

You agree to defend, indemnify, and hold harmless Nyza Creations LLC, Hardik Trehan, Nyza Studios, and their officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your content, your AI inputs, or your violation of these Terms or any applicable law.

13. Termination

We may suspend or terminate your access to the Site at any time, for any reason, with or without notice — including for violation of these Terms or the AUP. You may stop using the Site at any time and cancel any active subscription from your account settings. Sections that by their nature should survive termination (Disclaimers, Limitation of Liability, Indemnification, Governing Law) survive.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Washington, U.S.A., without regard to its conflict-of-laws principles. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in King County, Washington, and you consent to personal jurisdiction there. See the Contact & Disputes page for the informal resolution process we ask you to try first and details on consumer-protection venues that apply regardless of this clause (e.g. small-claims court in your home district, EU Online Dispute Resolution platform).

15. Changes to These Terms

We may update these Terms over time. The “Last updated” date at the top reflects the most recent change. For material changes we will notify signed-in users by email or in-product notice. Continued use of the Site after a change means you accept the new Terms.

16. Miscellaneous

These Terms (together with the documents they incorporate by reference) are the entire agreement between you and us regarding the Site. If any provision is held unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
